WELLINGTON and BARROW Terms and Conditions of Trading Welcome to wellingtonandbarrow.com. Wellington and Barrow provides access to the wellingtonandbarrow.com website under the conditions set out in this document. Please read these conditions carefully before placing your order. By using the wellingtonandbarrow.com website, and by entering into a transaction with Wellington and Barrow, you signify your agreement to be bound by these conditions. Contract When you place an order to purchase a product from wellingtonandbarrow.com we will send you an e-mail confirming receipt of your order and listing what is on it. Your order represents your offer to purchase a product from us. When we send you an e-mail confirmation (via Google Checkout) that we have dispatched your order to you (the "Dispatch Confirmation E-mail"), this represents our acceptance of that offer, and the contract between us is enacted at this point. If we are unable to deliver any product(s) from your order, these will not be included in the Dispatch Confirmation E-mail and will not form part of that contract. Deliveries You can place orders via the internet or over the telephone. FREE DELIVERY ALL UK MAINLAND POST CODE ADRESSES FOR ORDERS OVER £25.00. Please note this excludes addresses in Northern Ireland, the Channel Islands and other UK offshore destinations. Orders we receive will usually be dispatched within 48 hours and delivered with seven days. Orders weighing under 1kg are normally sent by First Class Mail (except for fragile or oddly shaped items which are boxed and sent by courier). Orders over 1kg are dispatched by courier and are usually delivered within the week. If you need to specify a delivery date, please telephone us. Payment will not be taken until we confirm that the items you have ordered are available. However, if our stock records are incorrect and you are charged for something we cannot actually deliver, you will be refunded immediately and we will notify you by email or telephone. If You Need to Cancel Your Order Please telephone us to ensure we can act immediately. It is possible to cancel your order any time up to it being dispatched. RETURNS Exchanges Should you want a different size or colour (ie an alternative of the same price), please return the unused product, in the original packaging within 30 days of receipt, stating what alternative you require. Wellington and Barrow will waive the delivery charge on the replacement item. Goods that are Faulty, Sent Incorrectly, or Damaged in Transit Please telephone us within 2 working days of receiving your parcel to advise us of the problem. Once we have received the goods back, we will refund you in full, including the original delivery charge. Other Refunds You may return goods for any reason up to 30 days after delivery. Unless the return is due to product failure, the product must be unused and in its original packaging. The purchase will be refunded but Wellington and Barrow will not normally refund the original delivery charge apart from cases of damaged, defective or incorrect products. Please note, if your order was placed by telephone, you may need to give us your credit card details again, because we do not keep credit card records. Wellington and Barrow’s Terms and Conditions obviously do not affect your Statutory Rights. Privacy and Security Wellington and Barrow will NOT pass on any of your personal details to any other company. However, some of the information we get from you will be useful to us in improving our products and services. We would also like to inform you about any new products or special offers. We will therefore retain your contact details for these reasons unless you ask us not to, either at the time of ordering or by contacting us at a later date. All financial transactions made by email are handled by Google Checkout under their strict security measures to which we have no access. If you order by telephone, we will destroy your credit card details after processing the order. Representation and Continuity Wellington and Barrow’s sole aim is to succeed by selling good products with good service. We make every effort to ensure our products are described and portrayed accurately. However, on-screen images may differ slightly from the actual article; colours are often different on a computer screen; and other unintentional errors may occur from time to time. We are always delighted to receive comments and suggestions from our customers. Despite our best efforts, a small number of products on our website may be mispriced. Rest assured, however, that we verify prices as part of our dispatch procedures. If a product's correct price is lower than our stated price, we charge the lower amount and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation. However, if you think there is an error in the amount you have been charged, please do contact us. We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. Linked Websites. Export & Customs When ordering goods from Wellington and Barrow for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Wellington and Barrow, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities. Your Health & Safety We are proud of all our products and stand by their quality and their suitability for their intended purpose. However, it is your responsibility to ensure that products are used and maintained appropriately Children Wellington and Barrow does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use wellingtonandbarrow.com only with the involvement of a parent or guardian. Events Beyond our Reasonable Control We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. Governing law and jurisdiction These conditions are governed by and construed in accordance with English Law and European Trading Regulations.
